Public Notice of Proposed Zoning Bylaw Amendments

The City of Kimberley approved first reading of the following proposed zoning bylaw amendments on Monday, May 13, 2024. It is anticipated that second and third readings of the bylaw amendments will be considered by Council at the May 27, 2024 meeting.

Bylaw No. 2764, Amendment No. 173, 2024 to City of Kimberley Zoning Bylaw No. 1850, 1994

This zoning amendment is intended to permit small-scale multi-unit housing (SSMUH) in accordance with Provincial legislation introduced through Bill 44. Bill 44 made changes to the Local Government Act that require local governments, including the City of Kimberley, to permit SSMUH in zones restricted to single-family and duplex dwellings.   

The zoning bylaw amendments to permit SSMUH generally include:

  • Add new zone RL to allow up to two dwelling units;
  • Add new zone RS to allow up to six principal dwelling units; 
  • Add new zone RSMH to allow up to six principal dwelling units, with limited provision for mobile home use;
  • Add new zone RSTA to allow up to six principal dwelling units, with limited provision for tourist accommodation;
  • Rezone properties zoned R-13 and some properties zoned R-1 and CD-4 to new RL zone;
  • Rezone properties zoned R-2, R-6, R-8, R-8A, R-9, R-11, R-14, and some properties zoned R-1 and CD-4 to new RS zone;
  • Rezone properties zoned R-4 to new RSMH zone;
  • Rezone properties zoned R-7 and R-7A to new RSTA zone; and
  • Amend CD-5 zone to allow up to six principal dwelling units, and amend setbacks, lot coverage, and parking required to allow SSMUH;
  • Delete R-1, R-2, R-4, R-6, R-7, R-7A, R-8, R-8A, R-9, R-11, R-13, R-14, CD-4 zones.

Bylaw No. 2764 may also be viewed in-person at City Hall on weekdays (excluding statutory holidays) between the hours of 8:30 am and 4:45 pm.

Bylaw No. 2765, Amendment No. 39, 2024 to Alpine Resort Zoning Bylaw No. 2016, 1999

This zoning amendment is intended to permit small-scale multi-unit housing (SSMUH) in accordance with Provincial legislation introduced through Bill 44. Bill 44 made changes to the Local Government Act that require local governments, including the City of Kimberley, to permit SSMUH in zones restricted to single-family and duplex dwellings.   

The zoning bylaw amendments to permit SSMUH generally include:

  • Add new zone RRS to allow up to six principal dwelling units;
  • Add new zone RRSTA to allow up to six principal dwelling units, with limited provision for tourist accommodation;
  • Rezone properties zoned RRS-1 to RRS;
  • Rezone properties zoned RTA-1 and RTA-8 to RRSTA;
  • Amend parking requirements for dwelling units in accordance with Provincial guidelines.
  • Delete RRS-1, RRS-2, RTA-1, RTA-2, RTA-5, RTA-8 zones.

Bylaw No. 2765 may also be in-person at viewed at City Hall on weekdays (excluding statutory holidays) between the hours of 8:30 am and 4:45 pm.

The City of Kimberley hereby gives notice, pursuant to Section 40 and 94 of the Community Charter, of its intention to adopt Highway Closure and Dedication Removal Bylaw 2760, 2024.

Proposed Bylaw 2760 will permanently close an approximate 981m2 portion of unimproved road dedicated by Plans R210 and 4097, District Lot 1879, Kootenay District adjacent to the parcel at 255 Knighton Road, shown as “ROAD TO BE CLOSED” on reference plan EPP137288 prepared by Wade A. Roulette, BC Land Surveyor, and attached as Schedule A to the Bylaw. 

Any persons who consider they are affected by the proposed bylaw may make written representations to Council. Written representations must be submitted no later than 2:00pm on Monday, May 27, 2024 by email to planning@kimberley.ca, fax 250-427-5252, mailed or delivered to City Hall, 340 Spokane Street, Kimberley BC V1A 2E8. 

The City of Kimberley further gives notice pursuant to Sections 26(3) and 94 of the Community Charter of the disposition of the closed portion of road described in Bylaw 2760 to the Kimberley Helping Hands Food Bank Society, owner of the adjacent parcel at 255 Knighton Road, for the sum of one dollar plus expenses including survey and legal costs as well as any land title registration fees, property transfer tax and costs for advertising the public notice of road closure and disposition. The closed portion of road will be consolidated with the adjacent property owned by the purchaser.
